Welcome to the website of Dr. Cheryl Meier (“we,” “our,” or “us”). By accessing or using this website, purchasing a digital product, joining our email list, or participating in any of our online programs or community spaces, you agree to these Terms & Conditions. If you do not agree, do not use this site or our services.
Who We Are
Business Name: Dr. Cheryl Meier, Rise & Return
Website: drcherylmeier.com
Contact: drcherylmeier@gmail.com
Location: CA, USA
Eligibility
This website and our services are intended for individuals who are at least 18 years old (or the age of majority where you live). By using this site, you confirm you meet this requirement.
Use of the Website
This website is provided for informational and educational purposes. You agree to use the site only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the site.
Accounts, Programs, and Community Access
Some areas of our offerings may require an account (including access through Circle or another platform).
You agree to:
-
Provide accurate information.
-
Maintain the confidentiality of your login information.
-
Be responsible for activity under your account.
We may suspend or terminate access if we believe your activity violates these Terms or harms our community.
Purchases, Digital Products, and Access Delivery
When you purchase a course, membership, or digital product, you will receive access as described at checkout or on the sales page. Digital products may include video lessons, PDFs, live calls, and access to online communities.
You understand and agree that:
-
Digital content may be delivered instantly or on a schedule (drip content).
-
Access duration varies by product and will be stated at purchase.
-
Sharing logins or distributing content is not permitted.
Payments and Billing
Prices are listed in USD unless otherwise stated. Payments are processed through third-party payment providers. We do not store or process full payment card details on our servers. If you are purchasing a subscription or membership, you authorize recurring billing according to the plan you select. You may cancel according to the cancellation terms stated at checkout or in the refund policy.
Refunds and Cancellations
All purchases paid in full are final and non-refundable unless otherwise stated on the applicable sales page or at checkout.
Because our programs and digital products include immediate access to course materials, community spaces, and resources, we do not offer refunds once access has been granted.
Monthly Subscriptions and Memberships
If you enroll in a monthly subscription or membership, you may cancel at any time through your Circle account settings or by contacting us at drcherylmeier@gmail.com. Cancellation will stop future billing. You will retain access through the end of your current billing cycle. We do not provide prorated refunds for partial billing periods.
Payment Plans
If you enroll in a program through a payment plan, you may cancel future payments at any time. Upon cancellation, remaining payments will not be charged, and your access to the program and related community will end at the conclusion of your current paid period. We do not provide refunds for payments already made. Cancellation does not grant lifetime access to previously released materials unless explicitly stated at purchase.
Live Coaching Sessions
If you purchase a private coaching session, you may reschedule with at least 48 hours’ notice. Sessions cancelled with less than 48 hours’ notice, or missed without notice, are forfeited. At Dr. Cheryl Meier’s sole discretion, a missed session fee may be waived.
Community Conduct and Termination
We reserve the right to suspend or terminate access to any program, subscription, or community without refund if you violate these Terms, engage in abusive or unlawful behavior, or disrupt the integrity of our community.
Billing Disputes
If you believe you were charged in error, please contact us at drcherylmeier@gmail.com. We will review and respond promptly. Filing a chargeback without first contacting us may result in immediate suspension of access to programs and community spaces while the matter is investigated.
Certain jurisdictions provide mandatory consumer rights that cannot be waived. Nothing in this section limits any rights you may have under applicable law.
Intellectual Property
All content on this website and in our programs, including text, graphics, videos, audio, PDFs, worksheets, and course materials, is owned by Dr. Cheryl Meier or used with permission and is protected by intellectual property laws.
You may not:
-
Copy, reproduce, distribute, resell, or publicly share our materials.
-
Record live sessions or redistribute replays unless explicitly permitted in writing.
User Content (Comments, Posts, Community Participation)
If you post, comment, upload, or share content in our community spaces, you agree that:
-
You will not post unlawful, abusive, defamatory, harassing, or infringing content.
-
You are responsible for what you share.
-
We may remove content or restrict access at our discretion to protect the community.
By posting content in our community spaces, you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content in connection with our programs and marketing, unless you request removal.
Third-Party Links and Services
This site may contain links to third-party websites or services (for example, Circle, Vimeo, YouTube, scheduling tools, or payment processors). We are not responsible for the content, security, or privacy practices of third parties.
Third-Party Music and Media (YouTube and other platforms)
Some of our programs may reference songs, videos, or other media hosted on third-party platforms such as YouTube. When we include media, we do so by linking to it or embedding it through the platform’s official player where available. We do not upload, provide downloads of, or distribute copies of third-party music or videos.
All third-party media remains the property of its respective owners and is subject to the terms, policies, and availability of the platform where it is hosted. YouTube’s terms permit showing videos through the embeddable YouTube player, and also restrict reproducing, downloading, or distributing content except as specifically permitted.
Copyright owners may control how their content appears on YouTube, including the ability to monetize, track, or block use through YouTube’s copyright systems.
If a linked or embedded item becomes unavailable, is removed, or is restricted, we may replace it with an alternative resource or provide a substitute.
Copyright concerns
If you are a rights holder and believe any linked or embedded content in our materials should be removed or updated, please contact us at drcherylmeier@gmail.com with sufficient details and we will review and respond.
Disclaimer of Warranties
We make reasonable efforts to keep information accurate and current, but we do not guarantee the site will always be available, error-free, or fully up to date.
All content and services are provided “as is” and “as available.”
Limitation of Liability
To the fullest extent permitted by law, Dr. Cheryl Meier is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of this website, our content, or our programs, including loss of profits, loss of data, business interruption, or personal injury, even if advised of the possibility of such damages. To the fullest extent permitted by law, Dr. Cheryl Meier’s total liability for any claim arising out of or relating to these Terms, the website, or any product or service will not exceed the greater of (a) $100 USD or (b) the total amount you paid to Dr. Cheryl Meier for the specific product or service giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
Indemnification
You agree to indemnify and hold harmless Dr. Cheryl Meier from claims, damages, or expenses arising from your misuse of the site or violation of these Terms.
Force Majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet outages, technical failures, government actions, labor disputes, or other unforeseen events.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Time Limit to Bring Claims
To the fullest extent permitted by law, any claim or cause of action arising out of or related to these Terms, the website, or any product or service must be brought within one (1) year after the claim arises. Otherwise, the claim is permanently barred.
Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights.
You and Dr. Cheryl Meier agree that any dispute, claim, or controversy arising out of or relating to these Terms, the website, or any product or service will be resolved by binding arbitration on an individual basis, except as described below.
No Class Actions
You agree that any dispute will be brought only in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of class or representative proceeding.
Arbitration Procedure
The arbitration will be administered by the American Arbitration Association under its applicable rules and will take place in the State of California, unless the AAA rules or applicable law require otherwise. The arbitrator will have authority to award any relief that would be available in a court on an individual basis, subject to the limitations set forth in these Terms.
Exceptions
Either party may bring an individual claim in small claims court if eligible. Either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent unauthorized use of materials.
This arbitration agreement is governed by the Federal Arbitration Act.
Changes to These Terms
We may update these Terms at any time. Changes will be effective upon posting with an updated effective date.
